If an Indian citizen is arrested or detained in Azerbaijan, the person should ask the local authorities to inform the Embassy of India in Baku. A family member, friend, employer or lawyer who learns about the detention should also contact the Embassy and provide the detainee’s complete identity and location.

The Embassy may seek consular access, check the Indian citizen’s welfare, communicate with the relevant Azerbaijani authorities and provide appropriate consular guidance.

What to Do Immediately After an Arrest

What Is Consular Access?

Consular access means contact between the detained Indian citizen and an authorized representative of the Embassy of India.

After the Embassy learns about the arrest or detention, it may communicate with the local foreign office, police, prison or other relevant Azerbaijani authority to seek access and check the detainee’s welfare.

Consular access may include:

How to Arrange a Lawyer in Azerbaijan

A person arrested in Azerbaijan should obtain legal advice from a lawyer qualified to practise under Azerbaijani law.

The detained person or family should ask:

  • Is a lawyer being provided under local law?
  • Does the lawyer have criminal-law experience?
  • Which language does the lawyer speak?
  • Will an interpreter be required?
  • What is the professional fee?
  • What services are covered?
  • Will a written engagement letter and receipt be issued?

  • Can the lawyer obtain copies of case documents?
  • What are the next court and filing deadlines?

The Embassy may provide general information or, where available, details of lawyers. Providing a name or list does not normally amount to a guarantee of the lawyer’s competence, fee or outcome.

The family should verify the lawyer independently and avoid agents who promise guaranteed release through unofficial payments.

Can the Embassy Provide Free Legal Aid?

Free legal assistance is not automatic.

The Ministry of External Affairs states that, in some countries where pro bono lawyers are available, an Indian Mission may help arrange such assistance. Indian Missions may also support initial legal assistance for distressed Indian citizens in deserving cases.

Financial support through the Indian Community Welfare Fund may be considered for eligible Indian prisoners or distressed nationals. Such support is:
